WASHINGTON, DC: This week the United States Court of Appeals for the D.C. Circuit dismissed the appeal of an ex-Fox journalist following the district court’s order permitting Meier Watkins client, Dr. Yanping Chen, to depose the journalist to reveal the identity of her source.
Meier Watkins founding and managing partner Andy Phillips, along with counsel Shannon Timman, represent Dr. Chen in a Privacy Act lawsuit against various government agencies concerning the leak of Dr. Chen’s protected records to journalist Catherine Herridge.
On August 1, 2023, the United States District Court for the District of Columbia sided with Dr. Chen and overruled Ms. Herridge’s objections to sitting for a deposition and disclosing the identity the government official who unlawfully leaked Dr. Chen’s records. Andy and Shannon were then successful in convincing the U.S. Court of Appeals for the D.C. Circuit to dismiss Ms. Herridge’s appeal. The court issued its order on September 25, 2023, and this ruling paves the way for Dr. Chen to depose Ms. Herridge and discover the identity of her source.
